Los presentes Condiciones de Uso (en adelante, “las Condiciones de Uso”) establecen las condiciones bajo las cuales se ofrece a los usuarios el acceso al Sitio Web https://larosavermuteria.myrestoo.net (en adelante, “el Servicio”) que el titular del Servicio pone a disposición de los usuarios de Internet.

El uso del Servicio atribuye a quien lo realiza la condición de usuario del mismo (en adelante, “el Usuario”) e implica la aceptación íntegra de todas las condiciones legales, compuestas por estas Condiciones de uso, así como, nuestra Política de Privacidad y Política de Cookies. En caso de no estar de acuerdo con todo o parte de estas Condiciones Legales, el Usuario debe abstenerse de utilizar el Servicio.

Por medio de la aceptación de los presentes Condiciones de Uso, el Usuario manifiesta:

Necesidad de Registro

Para poder utilizar el Servicio es necesaria la aceptación de los presentes Condiciones de uso y la Política de Privacidad y de Cookies.

Para realizar una reserva mediante el uso de este Servicio es necesario el previo registro del Usuario. Los datos introducidos deberán ser exactos, actuales y veraces.

Mediante la aceptación de las Condiciones de Uso, el Usuario consiente que sus datos pasen a estar incluidos en los tratamientos de el titular del Servicio, el cual será conforme a lo previsto en la Política de Privacidad.

El servicio de Reserva tiene por finalidad la reserva de un servicio en nuestros establecimientos. No es posible garantizar una determinada ubicación en el momento de la reserva. La reserva será cancelada automáticamente ante retrasos que superen el límite de tolerancia de 15 minutos.

Toda personalización o solicitud especial debe ser informada de manera explícita y será válida sólo tras la confirmación expresa de la misma por nuestro departamento de reservas, pudiendo incurrir en costes adicionales.

Política de Cancelación

Ciertas reservas pueden requerir la aceptación de una Política de cancelación, indicando las condiciones de la misma durante el proceso de reserva.

El método de pago será mediante tarjeta de crédito o débito.

Para gestionar los cobros utilizamos una pasarela de pagos de terceros denominada Stripe, que cuenta con estrictos requisitos de seguridad y métodos anti-fraude. Stripe es una pasarela de pagos que acepta pagos por tarjeta de forma directa, sin registros adicionales para el Cliente. Toda la tramitación del cobro es ajena a el titular del Servicio, no conocemos ni conservamos datos de la tarjeta del Cliente, la información que llega al titular del Servicio se limita a la aceptación o no de la transacción.

Limitación de capacidad de reserva

La posibilidad de reserva está siempre condicionada a las limitaciones de capacidad del establecimiento que en cada momento existan, bien sea por la por la propia distribución de las mesas y atención de las mismas según las características de la reserva solicitada o por otras circunstancias, como pueden ser restricciones de capacidad de índole sanitario.

Exclusión de Usuarios

El titular del Servicio se reserva el derecho a impedir el uso del Servicio, ya sea de forma temporal o definitiva, a cualquier Usuario que infrinja cualquiera de las normas establecidas en estas Condiciones de Uso, la ley o la moral. Discrecionalmente, el titular del Servicio también podrá excluir Usuarios e incluso dejar de prestar total o parcialmente el Servicio cuando así lo considere oportuno para mejorar la operativa del Servicio y/o del resto de los usuarios del mismo, notificando previamente dicha circunstancia a los Usuarios afectados.

Discrecionalmente, el Titular del Servicio también podrá excluir Usuarios e incluso dejar de prestar total o parcialmente el Servicio cuando así lo considere oportuno para mejorar la operativa del Servicio y/o del resto de los usuarios del mismo, como por ejemplo, sin carácter limitativo, cuando un mismo usuario realice múltiples reservas o tenga un historial de incumplimiento de tales reservas, notificando previamente dicha circunstancia a los Usuarios afectados.

Compras

El usuario dispone de la opción de realizar compras de distintos productos, incluso de la posibilidad de destinar estos productos como regalo a un tercero.

El usuario declara que dispone de capacidad legal necesaria para actuar y contratar en la Web de acuerdo las condiciones contenidas en este documento contractual, las cuales declara comprender y aceptar.

Cada producto tendrá su precio y sus propias condiciones de uso que deberá aceptar junto con estas condiciones generales de uso y la política de privacidad. En cualquier caso, el producto queda sujeto a excepción de derecho de desistimiento del Artículo 16 de la Directiva 2011/83/UE del Parlamento Europeo y del Consejo, de 25 de octubre de 2011.

El usuario es el responsable de facilitar sus datos correctamente en los procesos de compra establecidos en la página Web del titular del Servicio.

Condiciones medios de pago

Como procesador de pagos utilizamos STRIPE, operado por Stripe, Inc. (EE. UU.), que recogerá la información de pago necesaria según el método de pago seleccionado.

STRIPE, dentro del ámbito de los servicios regulados prestados a nuestros usuarios como entidad de pagos electrónicos, recogerá y usará los datos personales con los siguientes objetivos: abrir y gestionar el saldo; recibir y abonar las operaciones de pago; gestionar las quejas y la relación de los clientes; luchar contra el blanqueo de capitales y la financiación del terrorismo.

El fundamento jurídico para la recogida y el uso de los datos es la ejecución de un contrato de venta del cual es parte, y ello, en base al Artículo 6, apartado 1, letra b), del RGPD.

I- That to use our reservation service and complete the forms incorporated in this Website, the Service Owner for this purpose will necessarily require the provision of certain personal data.

II- That in certain circumstances, such as compliance with a legal obligation or under accreditation of a legitimate interest of our Service, it will be necessary to identify the diners.

III- We collect anonymous data, without the possibility of identification with any person, to comply with the restaurant's information obligations regarding allergens, as well as to adapt the reservation to possible accessibility needs. Therefore, this information is not subject to European personal data protection regulations (Article 2, Article 4, sections 1 and 5 and recitals 14, 15, 26, 27, 29 and 30 of the GDPR).

IV- The data that users provide as a result of accessing and using the contact forms, accessed through the address https://larosavermuteria.myrestoo.net, or by phone call to the number indicated on the same Site, or those provided in the establishment itself, will be subject to automated processing, whose controller is the Service Owner, which is duly implemented.

V- By providing this data, the User expressly consents and authorizes the Service Owner to collect and process the relevant personal data requested in accordance with the purposes and under the conditions that are required in each case, this consent constituting the basis of legitimacy for processing. The data will be treated confidentially and may be used for the purpose of:

  • Making and managing (e.g., modifying, canceling, rebooking) reservations at our establishment.
  • Verifying duplicate reservations at our establishments or others that share our reservation system. This verification is limited to a technical process of detecting duplicates, without implying knowledge or detail of the reservation external to our establishments, nor the specific establishment where the duplication occurs.
  • Conducting satisfaction surveys, performing statistics and analyzing the data obtained from them, as well as from the reservations made, in order to develop basic user profiles that allow defining preferences that may be of interest in more detail.
  • Likewise, they may be used to perform statistics of the reservations made and send commercial or promotional information - even by electronic means - related to these services and products, among the activities that the OWNER carries out, directly by the OWNER, by any other company or organization directly related to the OWNER or by a company or organization contracted for this purpose, provided that the User has given their specific consent. The User will always have the possibility to revoke this consent.

VI- Data Retention. The Service Owner will process the aforementioned personal data in accordance with the informed purposes and under the conditions indicated by the Law, for the time strictly necessary to fulfill the informed purposes.

VII- Legitimacy. In any case, users consent to freely provide this data electronically or by telephone or in the Establishment itself, when the chosen service may require it. Additionally, as bases of legitimacy for the processing of their data, the execution of the requested service, the follow-up of legal obligations derived and our duly weighed legitimate interest are applicable.

VIII- The Service Owner has installed on this Website the technical procedures in accordance with the usual quality standards of the sector, necessary and required by the Law. So that it can guarantee, as far as possible, the secrecy and confidentiality of our communications. IX- Our reservation book service is developed and operated under Restoo technology, owned by the company Team Interactive, S.L., which is positioned as the data processor.

  • The Owner or the other responsible party has a legitimate interest in the transfer, in which case it will be informed in this privacy policy.

The User has the capacity to exercise their rights of access, rectification, deletion, limitation and revocation of their consent, so the information provided is revocable.
